#181 Avapon-plus Dear Roman, We evaluated the decision of the Labour Disputes Commission. According to the Commission, employer should have been penalized for the late payment, which in the present case amounts to EUR 31.62 (after tax). However, since you were overpaid in the amount of EUR 168.17 after the last payment, the penalties for the benefit of you are not recovered from the employer, as the overpayment is considered to cover the penalties to be recovered. In other words, the employer paid you more than you actually had based on the time you actually worked. Why do you think that you were paid less than you have actually worked? Do you have evidence that you worked more hours than employer show in official documents or that salary was calculated wrongly? In any case, without evidence that overtime has been worked, the case cannot be won. The procedure of canceling the labour contract is also in accordance with the Code of Labour of Lithuanian Republic. You were on trial period (3 months) and if during these 3 months the employer wants to fire the employee, it can do this if shows that the employee does not meet the requirement and qualification for the job. There is stated in the decision that you agreed to test your ability to weld and the results were bad. The other worker testified this. Therefore, according to the decision of the Labour Disputes Commission there is no ground for the appeal, unless you can provide evidence and explain what money you have not received.
